Who can use Accordial.
You must be at least 18 years old to create an account or use any feature of Accordial, including the free tier. We verify age at sign-up. Use of Accordial by a minor is a material breach of these Terms, and we will freeze the account immediately upon discovery.
You also need to:
- Have legal capacity to enter into a contract in your jurisdiction.
- Not be barred from using Accordial under any applicable law or under any prior decision of ours to terminate your account.
- Use Accordial only for personal, non-commercial purposes, except for licensed practitioners and coaches who have entered into the separate Practitioner Agreement.
You are responsible for everything that happens under your account. Because we use anonymous credentials (a username and a password you choose), your access to your account depends on the security of your password. If you forget it, your partner can generate a single-use recovery code. We cannot recover your account for you, because we have no way to verify your identity.
What Accordial is.
Accordial is a communication and reflection tool for couples. It includes:
- An AI-assisted communication layer that helps you draft, translate, and reflect on what you want to say to your partner, and notice patterns across your own conversations over time.
- An appreciation layer for sending acknowledgments and positive notes to your partner.
- An insights layer that shows reflective patterns derived from what you have shared with the app.
- A practitioner marketplace where you can book sessions with independent unlicensed relationship coaches on the platform, and book licensed therapists who deliver their sessions through their own practice tools.
- A co-parenting toolkit (Whole tier only) for separated parents to coordinate calendars, expenses, and decisions.
- A safety layer that surfaces crisis resources and supports you in stepping back from conversations that are escalating.
The platform is sold in three tiers: Free, Steady ($20/month), and Whole ($35/month). Pricing, included features, and tier differences are described on the pricing page and may change with notice.
What Accordial is not.
This section is the most important part of the Terms. We need you to read it.
Accordial is not therapy, counseling, or psychotherapy. The AI features of Accordial do not diagnose, assess, or treat any mental, emotional, or relational condition. The AI is not a therapist, does not form a therapist-client relationship with you, is not licensed in any jurisdiction, and is not bound by therapist-client confidentiality. Insights produced by the AI are reflective prompts, not clinical findings, not diagnoses, and not assessments. The AI is not designed to treat depression, anxiety, trauma, mood disorders, personality disorders, addiction, eating disorders, suicidality, or any other clinical condition.
Accordial is not mediation, conflict resolution, or arbitration. The AI does not act as a mediator, does not produce binding agreements between you and your partner, does not resolve disputes for you, and is not bound by mediator-client privilege under the Uniform Mediation Act or any state equivalent. Communications inside the app are not protected mediation communications.
Accordial is not legal advice. The AI does not provide legal advice. Co-parenting features and court-ready exports produce information you may choose to use in legal proceedings, but they do not constitute legal advice, do not apply state family law to your facts, and do not substitute for consultation with a licensed attorney. Court-ready exports are evidentiary tools you may show to a lawyer or to a court; whether and how they are admissible is a question for a court and your lawyer, not for us.
Accordial is not medical care. The AI does not provide medical advice, diagnose any medical condition, or recommend medical treatment.
Accordial is not a crisis service. The AI is not designed to handle suicidal ideation, intent to harm yourself or another person, ongoing domestic abuse, child abuse, or any other emergency. If you are in danger, contact 988 (Suicide & Crisis Lifeline), Crisis Text Line at 741741, the National Domestic Violence Hotline at 1-800-799-7233, or 911. Use of the in-app safety shield to access these resources is not a substitute for direct contact with the resource itself.
Accordial is not a substitute for human relationships. We design carefully against fostering dependence on the AI. The AI is a tool you use to talk with your partner, not a replacement for your partner.
The AI is not always right. The AI may misread tone, miss context, produce a translation that does not match your intent, or generate a reflective insight that does not apply to you. We provide editing tools, "this doesn't seem right" feedback, and confidence qualifiers in language. You are the final author of every message you send to your partner; you are responsible for what you say.
These limits are how Accordial is built and what we promise. They are not legal disclaimers stapled onto a different product.
Your account.
You sign in to Accordial using a username and a password you choose. If you forget your password, your partner can generate a single-use recovery code. Together these are your credentials.
You agree to:
- Keep your credentials secure. Use a device passcode and biometric lock. Store your password in a safe place, such as a password manager.
- Not share your account with anyone else.
- Not impersonate another person or attempt to create an account on someone else's behalf.
- Use your account for your own communication and reflection, not to harvest information about other people.
We cannot recover your account if you lose your credentials, because we have no way to verify your identity. This is a deliberate consequence of how the platform is built. Please do not lose your password.
You can delete your account and all associated data at any time from inside the app (Profile → Delete all data). Deletion is irreversible.
How you use the app.
You agree to use Accordial in good faith and in compliance with applicable law. Specifically, you agree not to:
- Use the app to threaten, harass, stalk, or abuse another person, including your partner.
- Upload, share, or process content involving anyone under 18 in a sexual, exploitative, or otherwise harmful manner.
- Attempt to extract personal information about your partner that they have not consented to share with you, including by using the AI to generate inferences about them as a person.
- Reverse-engineer, intercept, or attempt to access another user's account or data.
- Misrepresent the AI's outputs as the words of a licensed professional, a court, or any party other than the AI itself.
- Use Accordial as a substitute for emergency services.
- Use Accordial to coordinate any unlawful activity.
- Access the app through automated means, scrape data, or attempt to overload our servers.
- Build or train any other product on data you obtain from Accordial.
We may suspend or terminate your account if you violate these rules. Because we cannot identify you, we cannot warn you in advance through email; we may surface a notice in-app, or we may terminate access to a credential without notice in serious cases.
Your partner.
The hardest privacy and consent questions in a couples app are about the second person. Your partner is not just data inside your account; they are a person with their own rights.
When you share content about your partner with the AI, you confirm that:
- You are sharing your own perspective on a relationship you are part of.
- You are not using the AI to generate scores, flags, or labels about your partner as a person. The AI is built to coach the speaker, not to analyze the listener, and we will not generate diagnostic-style outputs about people who are not the active user.
- You will not represent the AI's reflections back to your partner as objective truth, expert opinion, or anything other than your own thinking aided by a tool.
If your partner uses Accordial as well, both of you will independently consent to the platform's terms and privacy practices. We do not allow one user to add a non-consenting partner to the platform. Partner pairing is consensual and revocable.
If you are in a relationship where you are afraid of your partner, please consider whether using a relationship app is right for your situation. Active Safety Mode, the safety shield, the National Domestic Violence Hotline (1-800-799-7233), and a trusted local resource may be more appropriate first steps.
The practitioner marketplace.
Accordial offers two distinct supply lines on the marketplace, and the differences between them matter.
Licensed practitioners. Therapists, LCSWs, LMFTs, and licensed psychologists who have completed primary-source license verification, identity verification, and a written agreement with us. Their profiles display their credentials, licensed states, and PSYPACT or compact authorizations. Sessions with licensed practitioners are professional clinical sessions under their license, delivered through the practitioner's own practice tools, with their own intake, consent, scheduling, payment, and confidentiality terms.
Unlicensed coaches. Relationship coaches who have completed credential verification (such as ICF ACC/PCC/MCC, CCE BCC, or a named relationship coaching program) and KYC for payouts. Coaches are not licensed mental health professionals. Coaching is not therapy, counseling, or medical care. Coach profiles display a "NOT LICENSED" badge, and a mandatory disclaimer interstitial appears before any coach booking.
The platform's role for coach sessions. For coaches, Accordial is a full-service marketplace: we verify credentials, handle scheduling and payment, provide the audio/video infrastructure for sessions, and take a 25% platform fee on coach sessions. We are not the coach, we do not direct or supervise the content of a coaching session, and we are not vicariously liable for the services delivered by an independent coach.
The platform's role for therapist sessions. For licensed therapists, Accordial provides discovery, booking coordination, and the AI pre-session brief — and deliberately nothing else. When you book a time with a therapist, the slot is held for up to 12 hours while the therapist confirms or declines; if they do not confirm, the slot is released. Once confirmed, you continue to the therapist's own practice: their intake, their telehealth or office session, their payment system, their records. Accordial does not host therapist sessions, does not process payment between you and a therapist, does not take any per-session fee from therapists, and does not hold the contents of your clinical relationship. Therapists pay Accordial a flat membership fee for access to the platform; this fee is independent of how many clients they see.
Booking limits. Licensed practitioner booking requests are geo-gated by the client's state and the practitioner's licensure. We do not allow you to request a clinician who is not authorized to practice in your state. Coach bookings are not geo-gated, because coaching is not a regulated professional service in most jurisdictions.
Your relationship with a practitioner. Your professional relationship with a therapist or coach is between you and them. They will provide their own informed-consent forms, fee schedules, cancellation policies, and (for licensed clinicians) HIPAA Notice of Privacy Practices. Read those documents. Ask questions. Your relationship with a practitioner does not run through us, and we do not become a party to it.
Coaching is not therapy. If you are experiencing a mental health crisis, suicidal thoughts, abuse, or any clinical condition, please contact 988 or a licensed clinician. A coach is not the right resource for any of those situations.
Subscriptions and payments.
We sell three tiers: Free (no payment), Steady ($20/month), and Whole ($35/month). Yearly plans are available at a 20% discount on the pricing page.
Subscriptions on iOS are billed through Apple's In-App Purchase system. You manage your subscription, including cancellation, through your Apple ID's subscription settings. Apple's terms govern the billing relationship.
Subscriptions on Android are billed through Google Play Billing. You manage your subscription through Google Play. Google's terms govern the billing relationship.
Coach sessions are billed through Stripe and accept Apple Pay or Google Pay only. Pricing is set by the coach. Accordial takes a 25% platform fee on coach sessions. Refunds for coach sessions can be requested in-app.
Therapist sessions are billed by the therapist through their own payment systems, under their own fee schedule, cancellation policy, and refund policy. Accordial is not a party to that payment and takes no fee from it.
Therapist membership. Licensed therapists pay Accordial a flat membership of $49/month or $470/year, billed through Stripe and managed from the practitioner portal. Members of the founding cohort pay nothing for the first 12 months from signup, and their rate is locked at $49/month thereafter for as long as their membership remains active. Membership can be cancelled anytime, effective at the end of the current billing period. Membership fees are independent of session volume; Accordial takes no per-session fee from therapists.
Auto-renewal. Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before the renewal date, per Apple and Google billing rules. We do not control the renewal mechanism, and we do not have the ability to prevent or delay a renewal that has been scheduled by Apple or Google. Cancel through your Apple or Google account.
Refunds. You can request a refund for any subscription period or coach session through the in-app refund flow. Subscription refunds are processed by Apple or Google under their refund policies. Coach session refunds are processed through Stripe and reach your wallet within 5 to 10 business days. We do not require you to identify yourself, contact support, or explain why to obtain a refund. Refunds for therapist sessions are governed by your therapist's own policies and handled directly with them.
Price changes. We may change subscription prices for new billing periods with at least 30 days' notice posted in-app and on the pricing page. Existing billing periods are not affected. If you do not agree to the new price, you can cancel before the next renewal.
Taxes. Subscription prices are inclusive of any taxes that Apple or Google charges on our behalf. Coach session prices may be subject to local sales tax depending on the coach's jurisdiction. Taxes on therapist sessions are handled by the therapist in their own billing.
Crisis resources and safety.
The app contains a persistent safety shield icon and a "Need support?" overlay with crisis resources. Tapping the shield is a private action; we do not log it.
The AI is designed to surface crisis resources when it detects content suggesting risk of harm. The AI is not designed to handle a crisis. If you or someone you know is in immediate danger, contact 988 (US Suicide & Crisis Lifeline), Crisis Text Line (text HOME to 741741), the National Domestic Violence Hotline (1-800-799-7233), or 911.
We do not contact emergency services on your behalf, and we do not contact your partner, your family, or any other party based on detected content. The decision to contact a service is yours. If you are in a situation where you cannot make that decision safely, please reach out to a trusted person or to a crisis service directly.
If a licensed clinician you have booked through the marketplace identifies during a session a circumstance requiring mandatory reporting under their license, the clinician's reporting obligations are governed by their license and the law of the client's state. We do not influence those decisions.
AI and machine learning.
Accordial uses AI for translation, drafting assistance, reflective insights, and pattern recognition. You should know:
- The AI processes your inputs to generate outputs and is not always accurate.
- The AI is operated under contracts with our AI providers that prohibit training on user content. We do not contribute your conversations to AI model training datasets.
- The AI's behavior may change as we update the underlying models, system prompts, and product design. We work to make changes that improve the experience without surprising you, but the AI is not a fixed system.
- The AI is bound to the same content and safety rules as the rest of the app. It will not produce content involving minors in a sexual or exploitative context, will not produce instructions for harming yourself or another person, and will not produce content designed to deceive, manipulate, or coerce another person.
You may report any AI output you believe is inaccurate, unsafe, or unhelpful using the "this doesn't seem right" feedback button. We review feedback to improve the system.
Intellectual property.
Accordial owns the software, design, brand, content, and infrastructure of the platform. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app and the platform in accordance with these Terms.
You retain ownership of the content you create inside the app, including the messages you write, the conversations you have, the journal entries you keep, and any data you generate. We have no right to use your content for any purpose other than providing the service to you. We never sell it or use it to train AI models.
The AI's outputs in response to your inputs are made available to you for your personal use. You should not represent AI outputs as the work of a human author, a licensed professional, or any third party.
You agree not to:
- Copy, modify, distribute, sublicense, or sell the Accordial app or platform.
- Use Accordial branding, name, logo, or design elements in any way that suggests endorsement or partnership.
- Reverse-engineer the platform, with the exception of any rights you have under applicable law that cannot be waived by contract.
Disclaimers.
Accordial is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade.
Specifically, we make no warranty that:
- The platform will be uninterrupted, error-free, or secure against every threat.
- The AI will produce accurate, complete, or appropriate output in every case.
- A licensed practitioner or coach will produce a particular outcome from a session.
- Communications between you and your partner will resolve any conflict, repair any breach, or improve your relationship in any specific way.
Some jurisdictions do not allow the exclusion of certain warranties. To the extent any warranty cannot be disclaimed under applicable law, this section does not apply, and the warranty is limited to the minimum scope and duration permitted by law.
Limitation of liability.
To the fullest extent permitted by law, Accordial, our officers, employees, contractors, and affiliates are not liable for:
- Any indirect, incidental, special, consequential, exemplary, or punitive damages.
- Loss of profits, revenue, data, goodwill, or other intangible losses.
- Damages arising from a practitioner's professional services, which are the practitioner's responsibility under their independent license, agreement, and insurance.
- Damages arising from communications between you and your partner, including any harm caused by what either of you said or did.
- Damages arising from your reliance on AI output.
- Damages arising from a third party's actions, including Apple, Google, Stripe, our cloud provider, or any AI provider.
Our total liability to you for any claim arising out of or related to these Terms or your use of the platform is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $100.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation may not apply to you in full. In such jurisdictions, our liability is limited to the minimum extent permitted by law.
This section does not limit liability for willful misconduct, gross negligence, fraud, death or personal injury caused by negligence, or any other liability that cannot be limited by contract under applicable law.
Practitioner liability and indemnification.
Licensed therapists and unlicensed coaches on the marketplace are independent professionals, not Accordial employees, agents, or representatives. Their professional services are governed by their own license, their own professional liability insurance, and their direct agreement with you.
If a practitioner provides services that you believe fall below their professional standard, your remedy is against the practitioner, their license board, and their insurance, not against Accordial. We require licensed practitioners to carry professional liability insurance ($1M/$3M minimum for therapists; $1M/$2M minimum for coaches) and to name Accordial as additional insured, so that there is a real party in interest when a claim arises.
If a third party makes a claim against Accordial because of how a practitioner on the marketplace delivered their services, the practitioner indemnifies Accordial under the Practitioner Agreement. This is a term between us and the practitioner; it does not create a direct obligation for you.
Indemnification by you.
You agree to indemnify and hold Accordial harmless from any claim brought by a third party arising out of:
- Your breach of these Terms.
- Your use of the platform in violation of applicable law.
- Content you submit that infringes a third party's rights.
- Your conduct toward your partner or another user that gives rise to a legal claim.
This obligation survives termination of these Terms.
Termination.
You can terminate these Terms at any time by deleting your account.
We can terminate these Terms or suspend your access if:
- You violate these Terms.
- We are legally required to do so.
- We discontinue the platform.
We will give reasonable notice when we can. Because we cannot reach most users by email, notice may be in-app only.
On termination:
- Your access to the platform ends.
- We delete your encrypted data within 30 days, except records we are legally required to retain (described in our Privacy Policy).
- Any session bookings you have already made and paid for are honored or refunded; we will not strand you.
Sections that by their nature should survive termination (including 11, 12, 13, 14, 15, 17, 18, 19, and 20) survive.
Disputes and arbitration.
We hope you never need to use this section. If you do, here is how it works.
Informal resolution first. Before starting a formal proceeding, please email us at legal@tryaccordial.com with a clear description of the issue. We will work in good faith to resolve it within 30 days.
Arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the platform will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in the State of New Jersey, or in your home state if you prefer and the AAA agrees, in English. The arbitrator's decision is final and enforceable in any court of competent jurisdiction.
No class actions. You and Accordial agree to bring claims only on an individual basis and not as part of a class action, collective action, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
Exceptions. Either party may seek injunctive relief in court for intellectual property infringement or violations of confidentiality. Either party may bring a claim in small-claims court for an amount within the court's jurisdiction. Nothing in this section prevents you from filing a complaint with a regulatory body that has jurisdiction over the dispute.
Opt-out. You can opt out of arbitration by emailing legal@tryaccordial.com within 30 days of first accepting these Terms, with the words "Arbitration Opt-Out" in the subject line and your anonymous account ID in the body. If you opt out, both parties may pursue claims in court instead.
Governing law. These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. The Federal Arbitration Act governs the arbitration provisions.
Changes to these Terms.
We may update these Terms when the product changes or when the law changes. When we make a material change, we will:
- Update the "Last updated" and "Effective date" at the top.
- Post a clear in-app notice at least 30 days before the change takes effect.
- Maintain a public changelog at tryaccordial.com/terms-changelog.
If you do not agree to a change, you can delete your account before the effective date. Continued use of the platform after the effective date means you agree to the updated Terms.
Miscellaneous.
- Severability
- If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
- No waiver
- Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment
- You may not assign these Terms. We may assign these Terms in connection with a merger, acquisition, or sale of substantially all our assets, with notice to you.
- Entire agreement
- These Terms, together with the Privacy Policy and any feature-specific terms posted in-app, are the entire agreement between you and Accordial and supersede any prior agreements.
- No agency
- Nothing in these Terms creates a partnership, joint venture, employment relationship, or agency between you and Accordial. Practitioners on the marketplace are independent contractors, not Accordial employees or agents.
- Force majeure
- We are not liable for delay or failure caused by events outside our reasonable control, including natural disasters, governmental action, war, civil unrest, network or infrastructure failure, or pandemic.
- Notice
- Notices to Accordial should be sent to legal@tryaccordial.com. Notices to you are typically delivered in-app, because we have no other way to reach you in most cases.
- Language
- These Terms are written in English. Translations, if any, are provided for convenience and are not authoritative.
